I was paying plenty attention. Like I said the deer was at the peak of a hill, and the 328i is a pretty low car so the lights don't shine that far when you're going up an incline. Needless to say I was hardly expecting the full body of a dead animal to be laying in the middle of the road, so there was the element of surprise.

To be clear, the deer was already dead. He wasn't moving. In that sense my scenario is similar to OP's.
