Haha, is that the one available only to a particular dealer in a small town in Texas? That resulted in like a 10 year ban didn't it? In my prior life I owned an STS 91 EF.
My guess is that Doug already knew they were legal and it was just a matter of time. Right now the FRS isn't an overdog in class, so the whole issue may be moot.
