The driver of the black sedan who hit the guy clearly did not know where is the best course of action to avoid accident. There are two wide open lanes on the *right* where he/she could have missed the guy. Instead, he/she tried to squeeze to the left, without knowing there is a vehicle just on that lane already.
Well, if the black car does not steer left and stop, it would hit the Rav 4, and plunge into the van. The guy inside the van may get hit on his leg as well because his legs may not be inside just in time.
I would say it is 100% the black sedan's fault. He/she was driving too fast too close to the Rav 4, and not paying attention on his front traffic, and not steering to the *right* direction to avoid the accident. Although, that guy could still be hit by the vehicle filming the whole thing, but it would be just a bruise to the body.
Edit: one last observation. The guy actually landed on his buttocks and bounce off a bit. I wonder if there is any spinal damage besides the legs.
