1) Yes - you can disable the P0420 DTC with any flashing tuning solution.

2) Depends on your state and condition of exhaust system. Technically, as soon as you touch either of the OEM cats, it's no longer in compliance. Some states will perform a visual test and you'll fail that immediately. Others will perform a sniffer test and depending on how well your secondary cat works, you may or may not pass. Still other states perform only an OBD2 readiness test, and in those states, you'll pass, assuming the other sensors are all reporting OK and ready. You can use an app like Torque or some other OBD2 scan tool to check the readiness status of all of your sensors. Some states allow you to fail 2 of them and still consider your car passable.
