It'd be viewed as only circumstantial. The presence of the clamp wouldn't be enough to prove anything by itself. However, it could lead to other things being looked at.
It also depends on who does the investigation. I highly doubt yhe insurance company will work directly with Subaru. The average insurance appraiser would probably over look the clamp.
Again, I'm just making general assumptions, so there's no telling how the situation would or has already play out.
