I don't see how they can deny the warranty if they have no way to prove it, especially since you are being so open. I am sure if they wanted they could tell if something had been modified and also do forensics on the ECU.
On the flip side I can see where other performance shops would mod the hell out of the car, beat it to death, and then try and get warranty work performed. Clearly, you guys are not that kinda shop.
Hopefully you can get this resolved one way or the other. As you stated in your original post both Subaru and Toyota have marketed this car as a sports car to take to the track. Which you did. There should be no harm in that, not to mention you are not the only person that has observed the DI issues, so this is not an isolated incident.
