Here in The People's Republic of California, there's an unelected group of lawmakers who control what is and is not legal for use on public highways. We call them CARB.

CARB is an acronym, stands for California Air Resources Board. If you want to have an aftermarket part certified as legal for California highways, you ask nicely, prove that your part doesn't make the emissions worse, prove that the part isn't easily modified in such a way (adjustable) to make the emissions worse, and then bribe them with large sums of money. Then CARB generates an Executive Order number that you can slap on your shiny new part to show an inspector that your part is CARB Certified.
