Can I get my deposit back if I change my mind on a Scion FR-S?
 

I went to a Scion dealership and they said they got a black manual coming in and I can claim it by putting a deposit on it. Later as I found out on the VIN paper that the car is a Firestorm red (dealer can't tell the difference from exterior and interior) and calculating the monthly payment that they shorted me a grand on my trade in. I called them up and they told me they will look for a white one to trade for and have them "switch" at the port when they arrive. Been 3 days and they said they still have not got any luck getting a white FR-S. I feel like they are not trying at all and misleading me this whole time. Did not even offer an apology for the mistake on their behalf and said I have to wait while they try to find one for me.

So I went to a Subaru dealership and the place offered me 1.5k more on my trade in and got a black Limited manual that I wanted coming in two weeks. Dealer said I can claim this car but if I change my mind he can order me a white one that I prefer. Also the service was excellent and I didn't feel pressured into the deal versus the Scion dealer.


Long story short. Can I back out of a deal even thought I signed a purchase price agreement paper for a "Black Manual" that they got coming but because they can't tell the difference between interior and exterior on a sheet, it's really a Firestorm red. So now I'm waiting for them to find me a car from other dealerships.

Just need some help on this so I have some ammo when I walk into the dealer tomorrow to take my deposit back.

this is what my dealership told me
"most dealerships don't have the luxury of pre-ordering specific cars, the cars will roll in and they can trade with other local scion dealerships in the area"
this is why they didnt get the car you asked for, and they mislead you because they weren't being honest also my dealership said
"when a car comes in and it matches your preferences you will have first dibs on the car and we will give you a call"

my preferences are ANY color/AT so chances are i will get a car before the first person on the list, everyone else with a deposit at the dealership is reserved for manual im 3rd but might end up 1st depending on what comes in first
also dealerships will get 2-5 FR-S a month (my dealership is getting 3 a month)

dont flog me because AT my dad has a hurt knee and cant press the clutch very well and we will be sharing/building this car

we already have 3 cars in the driveway between me and him plus i already have a manual :P

The funny thing is when I first walked in and they had no clue what an FR-S was until they looked it up. Found out they had two coming in and mistakenly said they were both Black FR-S, one being a manual and the other automatic. So I said, can you get me a white FR-S instead. They said no, these are very limited models and "No dealer would trade their FR-S" so I can get a white one. So I said, okay I can live with a black one. Funny thing is now they don't have a black manual coming in and they want to do a trade with other Scion dealerships in the area so they can get me a white or black. When they 'clearly' said just before that other dealers won't trade their FR-S cars... This ALONE makes me not want to deal with their dealership and take back my deposit.

Steet Toyota/Scion in Yorkville New York. Please do not do business there.

yeah i would take my deposit back at that point, my dealership was up forward and actually told mt the truth about what they were getting, signed an agreement "no add ons or stupid shit like nitrogen in the tires"
