Refunding Deposit?
I was just curious if anyone has had their deposit returned to them.
I have left a deposit on a GTS Auto of $2000 and have waited 4 months with still no production date. I was told 3 months delivery when I purchased the car and there was no date of delivery on my contract.:( Yesterday I rang another dealer and they had the 86 that I wanted in their dealership for sale. I have bought it and pick it up on Tuesday. :D Now, how due I get my deposit back? Anyone else had this issue? |
You need to demand your deposit back... Saying they didn't meet the agreed upon time of delivery. You should have no problem getting your deposit back unless it was a custom order which would make things more difficult to get out of.. But without seeing your contract... It's difficult to determine..
I'm sure as long as you didn't order something too out of the ordinary.. The dealer can put the car on the lot and easily get another buyer.. |
I made sure my deposit was fully refundable and they knew what I wanted.
They called and said "We have your car!" I said "Cool how much is it!" "Oh only $1.5k more than the base car you asked for with options you didn't want!" "Give me my deposit back!" "OK!" Two grand sounds like a lot for a deposit, if I remember correctly the standard deposit was $500 (that's what I put down at both dealers) so your deal may be non standard and you might have trouble. Exactly the same situation as you, but I only deposited $500. I found another car at a different dealership, bought it, and asked for my deposit back. No problem. But I did ask the question before making the deposit, and had it in writing.

I think the term "demand" is a little too heavy. Just approach them in a polite business manner and ask they return your deposit. I don't see where you will have a problem.

Unless the paperwork you signed says there's no refunds on deposits, they shouldn't have any issue giving it back to you. When I had a deposit on a Focus ST, they had no issue refunding it after it never arrived.

He should have no issues at all at any time unless they specifically state (and you sign) it's nonrefundable. At worst, he should be able to take them to small claims court, at which point, any decent dealer will probably just give the money out of court rather than waste time and money over a grand.

My deposit paperwork stated that the deposit was 100% refundable and non-binding. I was in a similar situation, and after I had purchased my FRS I went back to the other dealer where I had my deposit and they refunded my money without issue.

Similar situation, signed a contract and put down a significant deposit on another car but never took delivery
Went to a Subaru dealership who told me as long as I did not take delivery, I am not under any obligation and would be entitled to get my deposit back May differ from state to state |
