Best way to cancel?
 
I'm going to cancel my order this week, is there an easy way for me to transfer my spot to someone else? Or just leave it bump the next person in line?

I've already bumped the que down when I changed my order from Silver to White.

Was told another 10+ months etc.

I'm over the 86 now, was an impulse buy anyway should have stuck to my original plan oh well.

Any advice appreciated thanks. :burnrubber:

On the back of your contract item 4.2 states that the dealer will deliver the new car within 3 months of the contract date.
So the contract isn't binding with 10 months to go. Just say you've changed your mind and want your deposit back. I think they lose the order under new terms with Toyota and the car goes back to the importer to pass on?

The contract I signed states "delivery may exceed 3 months" etc

It states a delivery date is required to void that clause. If they mess with the terms of the contract they need to get right or it's invalid.
Read that clause.


Did you sign it before the spare wheel was deleted?
That gave the chance to cancel the contract when they deleted it.

Nope don't have that part on my contract, there's only like 2 paragraphs that's it

I order on the launch week so the wheel could be used. Thanks.

Good, about the wheel.

I'm in WA too and this is the standard contract of the MTA[motor trader association] It's covers the back of the contract and covers all the contract terms and conditions.
There are 18 sections in all. They all use the same contract when I buy a car.

It states in small print at the bottom- MTA-WA 2012

Even though the contract is printed on A4 paper, at the back of it there should be a standard T & C from MTA-WA.

Anyways I think you can cancel since your vehicle won't be there in the next 3 months and/or you can also jack up the spare wheel thing!

If they didn't give you a copy of the contract AND the terms of the contract then it's invalid.
At the top of the back of the contract, under terms and conditions it states that under the Motor Vehicle Dealers Amendment Act 2002 they must provide you with that.
They have their copy. Just walk in and ask to see their copy and take it from there. Then you read it and say your bit.
What deposit did you pay?
I'm amazed they didn't give you a copy of the contract? That's what they have to do to make it legally binding and they know that.

And this was back in June?
Why was it faxed are you miles away from them?
They are obliged to make sure you are informed of the terms and conditions of the contract before you sign. If they posted or faxed it to you they had to confirm that you had read and understood the terms and conditions before you signed it and returned it to them to accept.
I would go in there with what you have and ask to see the principal of the dealership. Tell them what you have and when and that you want your deposit back.
On the face of it there is no contract for them to enforce 15% damages as per contract.

I ordered it during launch night, which was a non trading night so they couldn't legally take my preorder at 8pm or whatever it was but they did it anyway.

Because of the legalities I had to sign during a trade day (following day) thus faxed it back to them as I was at work...

I don't plan on going into the dealership, it's out of the way and I can't be bothered.

E46 M3 and start saving for a 1M.
