VVT not engaging. throwing P0137 code

Ive got a 2013 brz with a jackson racing supercharger and a HRI tune. The car had a fresh rebuild and now after fresh tune and flash VVT wont show up as engaged in logs. It is occasionally throwing a p0137 code. I dont know if this would keep VVT from engaging. Ive tried waiting 15 minutes for the car to warm up and made sure not to touch gas pedal on first start up. I cant for the life of me figure it out. Ive attached a log file as well as a video of all VVT paramaters during idle.

probably not, but check your engine oil level. many times in my work I see vvt not activating with low oil levels
