cars are damaged in shipping all the time. plenty of stories of brand new cars getting replacement doors, hoods, wheels, and going right out onto the new vehicle line.

'new' means it's never been titled. not that it's never been scratched.

Getting replacement parts to replace damaged items is different from a repair not being properly completed (IMO) and the car being placed on the line as a new car. A future buyer would likely end up back at the dealership trying to get that clutch replaced only to be told that the flywheels showed evidence of abuse and he or she was responsible for it.
