Seems that I am finally getting the ball rolling with the bodyshops owners insurance, they are gathering all the information (police report, picture, work order, etc).
Prior to this they basically said it's not due to his negligence and it's my fault for not having comprehensive insurance... after outlining the OAP4 for them in an email - all of a sudden they started working. I greatly appreciate that @Canehda - I had no idea If his insurance company refuses to pay I'll have to file a small claims court case against the bodyshop and then the owner will have to figure out a way to pay for the loss |

Yeah there still needs to be negligence on the shops part but I think the fact that you said they left the keys in the car is more than enough to prove negligence! And yeah even if you go to small claims court then you would then just force them to open a general liability claim!

5 millions years later, got a cheque from intact insurance (body shops insurance) Also got reimbursed for my travel expenses which was nice. Big thank you to everyone. except cole lol, cole is a troll I think an s2000 is next on the menu but for now i’m just puttering around in old camry that won’t die. |

I remember when my Jeep was stolen last year I harassed the hell out of Aviva until they Fed EX'd my payout check. Took approximately 6 months from when the claim was made to when I got the check in my hands. Glad it worked out for you in the end.
