Insurance wise u are probably ok if u were stopped during the incident. I think the Cadillac driver will have a hard time to explain if he was not in complete stop at the incident. If he was not in complete stop when this happen, he would need to pay 50% of ur damage and lost the claim free status.

Btw I thought there is a retired insurance agent in this forum. Maybe he has a better explanation on this situation.

Giccin 03-27-2011 05:02 PM

If shes going to be a little punk about it. Tell your insurance that you're feeling neck pain. LOL :P

Pics of girl? haha XD

you should of given her a **** punt

Hey don't you guys have laws against driving and cell phone use?

4agze 03-27-2011 06:39 PM

We told her to calm down let the insurance people take care of it, she's all crying and saying she's having a bad day, I told her then she should have stayed home.

Couldn't you look at her phone history?

I mean if there a law against it I figure it would mean that if they suspect that was the case they could look at her phone records and see phone calls and duration and if that matches up with time of accident

either way glad to hear you and the wife are not hurt

You got a 7th gen, me too!

You gonna mod it??

RRnold 03-28-2011 08:28 PM

Sorry to hear that Melvin! Hopefully you got everyone's info and PROOF that she was the who caused it b/c she was talking on her cell phone. Even though a rear end collision is 99% the other person's fault, she may later on might change her story which could impact the case/settlement.
