Willing to entertain reasonable offers!

Got a CarMax Appraisal Offer for $20,500.

First buyer to bet that offer gets the car.

If not sold by the 29th of July, car goes to CarMax.

Mods, feel free to delete this message if it's inappropriate but I feel it necessary to warn people about dealing with this person.

I've been emailing back and forth with him about this vehicle for several days. He came back with a price that we both agreed upon. I even made sure he was serious about going through with the deal by speaking to him directly on the phone. I purchased a non-refundable plane ticket to fly out and pick up the car. In addition, I made changes in my schedule that will effect me in other monetary ways that I won't get into.

Today he received the carmax and decided that he wanted more money after making an already existing agreement. He set the price, I agreed to it, and I made arrangements for payment. I believe that it's extremely shady to do that to someone just because he could make a few hundred more by screwing me, but I'll let potential buyers make their own assessment here. I do not recommend dealing with this individual in any way.

Between myself and the djwishbone, we did not have any contract or agreement. No deposit was provide and no sales contract was made.

Me and djwishbone spoke at 11pm last night, I informed djwishbone of the CarMax offer at 3pm today. All plane tickets are fully refundable if cancelled within 24 hours.

If for whatever reason the airline refuse to refund the ticket, I will pay for your ticket djwishbone.

I do not feel that this is Shady in any shape or form.

We had a verbal agreement that you yourself put forward, I'm sorry if your word is only good if written on paper. Again, buyer beware.

Here's the email exchange later verified and agreed on the phone. Seems like an agreement to me, in writing no less. Would it hold up in court? Of course not, but that's not really the point here. The point is that people shouldn't' deal with you.

Actually, a verbal agreement would hold up in court.

Statue of frauds says that certain contracts must be in writing to be enforceable by the court of law. A verbal agreement would not hold up in court. Goods worth more than $500, obviously the car is, must be in writing to be enforceable. You also need the signature of the party who is backing out (breaking the contract) to be enforceable. No contract has been formed. Sorry this happened to you djwishbone, cant do much here. I hope he refunds you the ticket at least.

Willfully or otherwise, you're missing the point of his post.

It's all good and well for you to offer to refund him, but the fact is you had a good faith agreement on pricing that you boldfaced reneged on.

What kind of buyer wants to take a chance on time and associated opportunity cost to fly out and be greeted with a higher bottom line?

And all for $500 no less?

Such a lack of integrity on display. GLWS
