Friend got screwed by dealer?!

So a friend of mine bought an frs because the previous owner had walked away from the sale .. He was told it would be ready for pick up the next day . The dealer then told him the sales guy had written down the wrong stock number and it was an frs with damage on it . He has a deposit and now the dealer saying he got to wait for another frs to show up.
Just wanted to see what your guys opinion is here .. Can he get deposit back ? Should he wait and try and get a better deal because of their mistake ?

did he sign a paper saying he cant get his money back?

I would wait for a new car why buy a damage Frs. If ur friend can't wait then go to other dealership there is more than one Toyota dealership in your area.

You think it was actually damaged? Or just an excuse cause he sold the car to someone else?

Or maybe just a lie saying that it would be in next day so he could get him to put a deposit down?

Never believe a car salesman.

Ye we assumed car was either sold to previous owner who had pre ordered or to someone else .. He might wait for a new one to show up, but trying to figure out what he should as from them to "make up" for their fuck up.
Any ideas ?

From what I know deposit can be taken back , because the car he bought (they claimed damaged afterwards) was never delivered to him. So no car = deposit back.

That is exactly what a few dealers told me. I put down a deposit for 1 car with a VIN, I was not on a waiting list and that car was mine. Now if it had showed up damaged I would get my full deposit back because the dealer could not provide the car.

Was the *damaged* car an ultramarine MT FR-S? During the early test drive there was one damaged in Calgary area by one test driver. I wonder if that one has been put back to the market.

For your friend, I would suggest he to wait for another one. What is the rush to get this car since you know they are coming in the near future. If he finds another one available, just grab that one and try to get the deposit back from this dealer.

Not sure coz they sold a charcoal to him which was brand new .. And then they told him it had damage 2 business days later . I know about the ultramarine and it had rim damage , which has been replaced with brand new rims .
