I find it interesting what businesses would do to all of us when they think they know the mailing address of the person behind a social media or forum account.

I’d just get a lawyer at this point

I find it amusing that David Pierini esq. just uses a regular old gmail address.

What's their obsession with modified images? Are they talking about the pictures with meme format explanations and red circles? I'm interested in seeing what makes them libelous.

I found that interesting too. I guess he does not want to use his official work place email or address which would be an email ending in the company name ALEPH ONE and an address in San Francisco :iono:

Everyone should look up how there are exceptions to copyright and defamation laws in the following categories:

- Parody (this is why the president can't sue anyone who mocks him on TV or social media)
- Presenting News & Commentary (why most bloggers/forum posts and news can not be sued)

Stern v. Delphi Internet Services Corporation, 626 N.Y.S.2d 694 (N.Y. Sup. Ct. 1995), addressed this question directly and held that the news and commentary exception applied to the defendant's online bulletin board service.

I'm presenting relevant news and commentary on issues of interest to those in the car/86 communities. That is how car forums can get away with saying shop XYZ is poop because personal experience 1,
to avoid shop XYZ because personal experience 2,
shop XYZ did this to me based on personal experience 3.

Another take away that most forum and social media users should be aware of in relation to reposing or memes:

Courts have shown over and over that if you are not the creator of the content, you can not be held liable for it.

I still really think they lack the funds to repay you, so this is sort of a last gasp to get you to back off them.

When all else fails, make everyone else feel like it's actually their problem...

So everyone is clear about the letter it is trying to tell me to not tell everyone to go to the Instagram account under the name @Xtra_slw and look at or re-post the mulit-picture posts which are talking about someones first hand account dealing with works motorsports to spread relevant news which would be of interest to the intended audience of car enthusiasts.

Just to repeat:

Please do not visit the Instagram account @Xtra_slw

Please do not look under the hashtag #WorksMotorsports

Please do not look under the location tag "Works Motorsports"

Please do not look at or re-post any of the pictures which are trying to share a customers first hand experience with works motorsports.

Didn’t they give you a loaner car? You also seem to leave out the part where you asked them to remove the kit because you were too broke to afford it.

I love how the obvious troll bumps up the threads so we can make fun of this works company some more.

I still can't get over they made you pay for something before they developed it. That sounds totally insane in every way.

I mean he’s just a flat out liar and neglects a lot of facts of the case. I can’t believe he thinks that posting racist memes and crying about an appeal and subsequent cease and desist are a wise idea. I hope he loses just so we can hear more about his sad little life.

He's only responded to this thread since he joined in January, which seems a little suspect for someone not directly connected to this to be this aggravated towards this guy and bumping his threads. Not sure if this is trolling but I would suggest you chill out, or be banned as he may be a shill for work motorsports or works directly with them somehow....
