SO my beloved Sylvia had her life cut short yesterday....

I was cruising down the highway in the left hand lane slowing down for traffic, the right lane was busy and had a break in front of a diner. A lady who was pulling out of the diner did not look left and pulled right out to try and make it. I was unable to see her until it was to late due to the car in the next lane. I asked her if someone had waved her on and she said no at the time, so im not ever sure why she tried to make a left turn on that road. Its one of busiest roads around here and you NEVER make a left turn without being absolutely positive.

I got beat up pretty good, pretty sure Sylvia is totaled. I took a look at her once she was towed, the support bars under the hood were bent and the firewall was pushed back about an inch on the passenger side.

First real accident I've ever been involved in, I was kinda shocked more so after the fact. When I got hit, the car barely had just came to a stop and I was out of the car making sure the other driver was okay.

Looks like she must have floored it to try to make the gap. Another one down but kept the driver intact!

Good to hear your family wasn't in the car! Sucks about the accident though. I've learned there is no shortage of bad drivers on the road.

She most certainly did. I had hit my brakes and swerved left to avoid it, had she hit her brakes we never would have touched.

Ouch! Painful photo; glad everyone was ok. Once again the twins earn their top safety ratings. You obviously love Sylvia, I hope Sylvia's successor takes as much care of you as she did.

As for the other driver, and what he/she attempted to do (cutting across a double yellow line, crossing multiple lanes of traffic, on a busy road), I see it much too often. There is no second thought of, "hey I could be dead in the next 2 seconds because there are 2 ton heavy things coming at me"... they just think, "damn, I need to get over there, NOW!" I swear it never used to be this way, and it's getting worse on a daily basis.

Unfortunately I have been in this scenario many times, people taking the "JESUS TAKE THE WHEEL" mentality as they shoot across a busy highway to make a left hand turn. However this lady I believe instead of looking left as she came out, decided to look right at the cars on the other side.

That sucks, sorry. Glad nobody's hurt. Such a stupid thing for her to do. Had some close calls, lots of stupid drivers out there. Some people in big suv's only see other big suv's. We are at a disadvantage being in a small low sports car. Had a guy timing a light not see me still in the intersection when he plowed into me, spinning me 360*. I was ok but my little opel gt was badly damaged... but not totalled.

Pretty sure there's going to be frame damage. Is this your first major accident? I would recommend getting a lawyer and having them sort everything out. You won't need to pay a cent out f your pocket if youre not at fault.

I am calling my Lawyer on Monday. My main concern is what I owe on the car. I'm positive there will be a few grand that they payout won't cover. I'm also not sure if I have GAP coverage and honestly up until this happened I had no recollection of it, however I do think my Credit union rep when I bought the car mentioned it and told me to get it, hope I'm not wrong.

However I've been told a few times now that because she is at fault, and this would not be an issue otherwise that they should be paying the remaining balance regardless. Hence what I'm going to be using my lawyer for.

Not to mention I got pretty banged up.

Why not use your insurance companies lawyer? That's part of what you pay for. "Hey, insurance dude! This is what happened, here's the report, call me when the clown that hit me and her insurance company pay off the total balance of my car. Feel free to mention the trouble I'm having walking if you need to."

Well, my insurance company wanted to total it. Her insurance company wants to fix it even with the estimated 15k worth of damage (without having even torn into it yet)

I could have nationwide total my car, pay it off and go after them. HOWEVER.. the shop is quite reputable and wants to try and fix it.

Thats my concern, however should it not be able to be brought back to 100% spec, well then it gets written off anyways.

Can't vouch for the US but up here the rule of thumb the companies use is up to 75% of the value gets fixed.

First and foremost, very glad you and the other driver came out okay. I'll echo the others here and think you should probably consult an attorney both for your injuries and your car. Personally, I wouldn't want to drive a twin that has suffered $15k+ in repairs and I doubt you do as well, so I'd fight to total it. If they make you keep it, make sure you fight hard for diminished value.

I find it hard to believe that her insurance company will not total your car with $15K damages in NY where the the total loss ratio (cost of repairs/actual cash value) is 75%.

I've spoken with two lawyers who have both said the same thing, in NYS I am fucked.

Payout on my car is 18,898 (thats minus my deductible which maybe ill get back when nationwide goes after the other insurance company) so 19,898 total..

I owe 21700 on the car.. so I'm out of pocket the rest of the money and I have 0 legal grounds to go after them to obtain the rest even though I was not at fault.

Such a bunch of bullshit what's happening to you. I pay the extra on my insurance out of fear of just this scenario. If they total it out can you try to sell the parts off it? Maybe you can make up the difference? It's heartbreaking to do it, but maybe it will cover the rest if you part it out. Poor car.

If they total it then the car belongs to the insurance company. If you take parts off it they will charge you for them. You don't get the money and the remains of the car.

I also pay extra for replacement value. If mine is totalled it is directly replaced with one a model year newer.
