Feeling like I just got robbed ..what to do?
 
So basically I purchased an used exhaust system from another member on the forum. Paid in full via paypal.

1st week = Thanksgiving holiday okay maybe just busy with family.
2nd week = Multiple emails requesting a tracking number. Finally responds apologizes for delay. Saying he is shipping it through a freight company, I should get a call to schedule delivery. And I should expect it early next week.
3rd week = No phone call from shipping company. I'm frustrated. Email him telling him if he hasn't shipped the item yet, to give me a full refund. It's been 2 days. No response. No shipping/tracking number.

What do I do? :mad0259:

Paypal will intervene nicely if you send a dispute through them.

Also, your signature is off. the man says "More than you can afford pal, ferrari."

Insert FR-S in place of ferrari.

Unless you sent funds as a gift, in which case, you're SOL.

When using PayPal, never use the gift option when buying something. They protect their customers pretty well and as long as you sent money using the correct payment option, they'll help you.

Unless you know the seller, never send payment via Gift. Pay the fee and sleep comfortable at night knowing you're backed for shit like this. I forget what its called but assuming you have his information and a copy of the dialog between the two of you, you can file a police report against him.

If you know the person's name...file a litigation with them.

Breach of contract. Out of state? Not out of luck due to the Long Arm Statue!

Sue in small claims court. Just prove your case and you can prove it through transcripts like text/messages.

Also...share the persons forum name so we can all be aware!

Some people aren't "with it" if you catch my drift. Not defending the seller, just pointing out that even some official companies lack proper business ethics. Could just be some kid who has no idea how to act like an adult.
I would dispute it with paypal and get your money back. This person doesn't seem serious enough to warrant any further interaction

Thanks! This will be my last option, hopefully it wont have to come to this. Wonder if anyone else has had any similar experience?

I hope this gets resolved, I feel bad for you man Attleast now you know not to gift anything and I have found on other forums that once someone receives a warning about getting banned for stealing, they usually either return your money or send the part pretty darn quick.

Always, in the description give a detailed invoice of what you're purchasing when outside of ebay. Good luck, let us know how it works out.

Thanks dood. I don't wanna just throw him in the fire so fast. I think I've been pretty patient. Gonna wait a few more days and pray he responds. Could totally be a misunderstand/miscommunication or maybe something really came up. Just sucks being in the dark about things.

You should PM him/her a link to this thread so he/she has a warning. If you have not already contacted an admin/ mod you should do so soon so that they can send him a warning message as well.
People don't like getting there name trashed so he should folow through after seeing the warnings and know that you are indeed serious.

The seller probably looks at this thread now and smile. I think you should call his name out so he can show up and explain for himself the reason for delay of shipping this TRD exhaust out to you.

Small claims has to be served in the state, out of state only applies to car accidents. You would have to file a limited civil action.

Even if you bought as gift, if you used money that was from your CC / bank account, you can get your money back. As long as it wasn't money that was already credited on your paypal account balance. Contact your CC company and tell them your computer got hacked or something. Just pretend like you have no clue how to use a computer.

If the transaction is backed by your credit card, just call them and request a chargeback, because you never got the item you paid for. They will give you your money back no problem.

If you used PayPal, use them for the dispute. It works very well and they will put a hold on the funds until the dispute is resolved or within 2 weeks if the seller doesn't come through. PayPal will credit your card with the funds. Very easy and no hassle.

He sent the money as a gift. The way paypal sees it, he did not purchase anything, he gifted the guy the money. Therefore there is no seller and no buyer. Just a gift. The other guy doesn't owe him anything in their eyes.

The bank/credit card company could still pull the money back if PayPal charged them for it. It would be a nightmare but the CC companies have A LOT of pull, it may even be over in 5 minutes depending on the service rep.

Gift transaction in PayPal are always bank transfer, or PayPal existing balance. It is NOT credit card, that would fall under the payment realm and subject the seller to fees.

For gift transactions: the bank would view it as a simple "wire transfer", there's no protection against that type of withdraw unless you pretend you got hacked, which is even more fraud.

So fraud on top of fraud wouldn't be a viable nor simple solution in this case

Paypal always protects the buyer, not the seller. You should be able to get your money back easily.

I don't think you'll get your money back. The Scammer probably transfer the money out of his/her paypal account so even if Paypal rules in your favor, there's no money to give back.
