So This Happened
 
On November 1st, I got hit :cry:.

I was turning left onto 29. I had already crossed over the lanes going right, and had a large gap in the left lane of the 3 lane road, so I took it. Then, after I was halfway in the lane, a lady in a white Nissan Altima changed lanes without looking and slammed into me. I saw her coming at the last second and was fully stopped when she hit me, but the Boulevard law in Maryland say that because I was coming from a smaller roadway, everything is my fault. I'm hoping to get her with contributory negligence, which would mean I wouldn't have to pay for her car, but I don't think I have a great chance of that. No witnesses stopped, or even slowed down. They all just kept driving, so I have no proof other than what I say happened.

PS: There was no mechanical damage to either vehicle. Thank Glob.

The moral of the story is two parts:

1) Watch out for situations like this in Maryland. Don't trust the system to make the right choice.

2) ALWAYS stop when you see an accident. We need all the witnesses we can get.

Also, Maryland drivers suck. Even worse in DC. I've driven in the Middle East with those crazy drivers and it was still safer than the DMV.

Sorry to hear you've had an accident too :(. And, yeah, I agree about the drivers here. I'd be safer doing wheel-to-wheel than commuting in the DMV.

did she signal? if she signaled its your fault... if she didn't, I think it should be HER fault. IF a person is mergeing in front of you and has their blinker on you should yield right of way.

Signal or no signal, it doesn't matter. He was making a left turn across another roadway, so he has to yield to ALL traffic before pulling out. Signals make no difference in the matter.

Put it this way--- what if you were pulling out of McDonalds and a car already on the road had it's turn signal on and appeared to be pulling into McDonalds. So you pull out in front of the car and BAM, the car hits you. Who was at fault? I'll tell you---you were at fault. This is Driving 101 and shouldn't be a surprise.

No, I had two accidents in 3 weeks in the first month of owning the car.
First was someone scrapped my front left bumper in a parking lot, payed outta pocket just so that my insurance wont go up. Not a week after the car came out of the body shop, I got T-boned in NVCC Annandale campus by a freshman who pushed my car about 90 degrees and claiming that I did not see her pull out. Had the right quarter panel pulled and the rear right wheel replaced along with the bearing. Then my taillights started condensing, then I got the crickets. So far, I spent 350 for the first accident. If I had payed for all the repairs and damages would is between 4000~4500.


Most people tell me to sell the car as it looks like bad luck. I denied it and told them I will ride the devil till I die.

He said he was already in the lane... If hes established hes in a lane, THEN PROPERLY moves RIGHT, thats not WHAT your describing. However if hes just one of these jacka$$es that just pulls out and cuts right across several lanes of traffic... I guess bad driving served him right.

There was no turn signal from her, and she did not start to change lanes until I was halfway in the lane. I understand the law, but really, she was very careless. The roadway is never fully clear, and it's my only exit from work. Unfortunately, I usually have no choice but to merge there while cars are moving in the other 2 lanes.

Yeah, the entire situation sucks. I've been in the same exact situation. You always have to watch for people changing lanes on a road like that. Unfortunately, you'll always get the blame because you're the one turning on to the other street.

Well, I was judging based on his pictures. It looks pretty obvious that he wasn't yet actually in the lane when he was hit. Looks more like the nose of his car was just entering the lane and his car was at an angle. How else could his car get that kind of damage only to the very right front corner of his car? I bet the other car had more damage because the corner of his car probably scraped down the entire side of the other car.

The problem is that thejevans was turning left. Which NEVER has the right of way. So it was thejevans fault. Does not matter what the other driver did.

If you wanted to get the fault shifted, you could have said that you were on your line and the other driver jumped onto yours.
Then there would have been a conflict of testimonials and each one of you pay your own.

I don't want to be cruel but the other driver had the right of way. Common sense would have told her not to change lanes but common sense also would have said "I wonder if she's going to change lanes. After all she has the right of way".

The same thing happened to me a while back (Thankfully not in the FRS). It was in Maryland as well.
They ended up saying we were both at fault, since the other driver should have signaled and shouldn't have changed lanes if there was a car coming into that lane. Basically something along the lines of the other driver not paying enough attention and should have saw me.
It'll depend on how convincing your insurance company is when they deal with the other person's insurance.

I've taken the practice of turning right and u-tuning at the next intersection just to avoid this. Granted its more a carryover from living in Fl where that's the only way to cross a 4 lane road.. but its been a pretty useful habit to have. VB isn't as bad as Nova but its a close second. People are just stupid to begin with, then they get behind the wheel and what little sense they had just disappears. Hope it works out for ya Jevans ;)

that happened to me before but the lady (same position as you) went out she was beind a big van she was driving a corolla and went out into my lane, and since i couldnt see her because she was behind van she came out and i couldnt stop in time (rain) slipped and ram right into her crushing her passenger door... After insurance and crap she was claming i cut her off or some bull. im like really? so i agree that person really did have right of way but yea sucks..

Biggest thing i hate the most in MD is the fucking drivers that slow down randomly. Or on highway after high speed, they choose to randomly stop.. The slow down thing is retarded, then theres text driving assholes swerving..

Alright, so my baby is all fixed up. They replaced the passenger side fender and the bumper. I think they did an amazing job on paint matching. I cant tell the difference. Here's how she looks:

The shop I went to is Burnt Mills Autobody. Highly recommended. They even reseated my laser jammers and radar detector (roughly).
