Just got rear ended today
 
Stupid girl not paying attention on driving I guess she on her cellphone, she hit an old cadi then the cadi hit us me and my wife. Sucks cuz my wifes accord is a cherry no dings or dent, stupid girl have the nerve to get mad on the cadi driver.

Yeah, she got some nerve. If I was da cadi driver I would be yelling at her instead! Hope you guys are alright. Car can be fixed quickly... our body is different story

Got hit above my rear passenger wheel arch in the ute sunday..... Sux.... Trying to sell it now gotta wait for insurance to sort it... Guy reversed out his driveway over 2 lanes into my mint condition PARKED 6 litre ute... To be its now de-flowered and i wanna get rid of it even more...
Sorry to hear 4AGZE!!!!!

Cant wait until its all fixed and sorted.. Sold and New S15 sitting in the driveway!!!

Insurance wise u are probably ok if u were stopped during the incident. I think the Cadillac driver will have a hard time to explain if he was not in complete stop at the incident. If he was not in complete stop when this happen, he would need to pay 50% of ur damage and lost the claim free status.

Btw I thought there is a retired insurance agent in this forum. Maybe he has a better explanation on this situation.

We told her to calm down let the insurance people take care of it, she's all crying and saying she's having a bad day, I told her then she should have stayed home.

Couldn't you look at her phone history?

I mean if there a law against it I figure it would mean that if they suspect that was the case they could look at her phone records and see phone calls and duration and if that matches up with time of accident

Sorry to hear that Melvin! Hopefully you got everyone's info and PROOF that she was the who caused it b/c she was talking on her cell phone. Even though a rear end collision is 99% the other person's fault, she may later on might change her story which could impact the case/settlement.

sorry this gonna be a bit of off subject, but wasn't there a Myth Buster episode that talking on the cellphone is dangerous as DUI wasn't it?

Did you guys get the police at the scene an confirmed that she is at fault? Without that it could be a problem.

Speaking of proof, nowadays it is getting popular to install cameras to both front and back to record traffic, or potential accidents happening to you. (this is popular in Taiwan. Btw) however. Even with video evidence. Some insurance agent only believe what their customer told them, and it may not be the truth.

Btw, how would you explain if the car suddenly stops in front of you if you have no witness?

Not really my car its the wife, my daily is a infinity G20 P10, well when I change something from OEM to something better like brake pads are now Hawk HPS, K&N airfilter, earls steel brake lines & KYB AGX shocks are the only mod (if you call them that) I put in this car.

well her insurance called today she's 100% at fault I'll bring it in for adjuster tomorrow and see what does on after that, she cant cry over this now lol

That's good to hear. I still need to bring my truck to the shop to get fixed from when the chick ran a red and hit my truck. I heard good reviews from Balboa Autobody
