Rear End Collision, Totaled?
 
I was rear ended earlier today by someone who I believe was texting and driving given that their phone was shattered in the accident. Of course they denied that they were texting. I was at a red light and it had just turned green and just as my car began to roll, I immediately got rear ended by a car going about 30 MPH or so. I am wondering if this damage is enough for it to be deemed totaled. There is some quarter panel damage and am unsure if it will make my car totaled or not. This is a 2013 FRS which I bought used December 2015 :/

Depends on the insurance especially on the costs right off the bat right quarter panel, tails lights, new rear bumper for certain.

Yeah if body is bent. Get a 2017 or wrx imo.

Looks to me like 8k damage compared to similar damages imo

time to buy a rear dashcam...a nice high quality camera would have captured what the driver was doing last few seconds before the crash aka texting

Did air bags go off? Air bags are damn expensive to replace.
I'm guessing its totaled by looking at the pix.

On my way home a few weeks ago I was waiting to make a left turn at a red light...the other cars from the were turning left past me and i'm people watching and i see this one young chick in her early twenties make the turn and immediately at the straight was looking down at her phone in front of her steering wheel...:mad0260:

Two years ago I would have said that was not probably a write off. Today I am not so sure. As the cars drop in value the line between cost of repair and price of the car also drops. Since most areas use a percentage of value as the determining factor and the price of repairs remains the same then they hit that write off threshold faster. The down side of this of course is that you also get less for it when they do write it off.

I would definitely be seeing a doctor and thinking about contacting a lawyer. That is a serious impact!


Even if it isn't totaled... I wouldn't want it back. That is rough.

Last week I made a left turn on a green arrow and some idiot comes flying thru the light, hits his brakes swerves between me and ends up plowing into the other lane of traffic which was at a stop (because when the lights red ya stop moron) Cop was behind me and I actually slept on the green arrow because I was messing with the radio. Thought damn, im gona get a ticket for not going when I was supposed to. Glad I slept on the light because that moron would have tore my car in half. I did not stop when I saw this idiot collide, I just went on, the cop lit up and pulled into the mess

The driver side airbag is the only airbag that went off.

Bummer :( the airbags alone plus the seatbelts will shoot up repairs high I would make sure to see the doctor as well too to make sure.

Try to get the max value you can from the car.

Yeah good thing is you're ok. If they don't total it, make sure you get compensated for everything, including the diminished value of the car. Regardless of how good a job the body shop will do, you'll get less for the car had it been accident-free. Can't escape the reality that is Carfax.

I wonder what the safety procedure is in an FR-S seconds before impact and during impact; considering how safe an FR-S is in withstanding an automobile accident...:thumbup: :bump: :scared0012:

Whatever you do, do NOT discuss this with the other driver's insurance until you are thoroughly checked out medically. They will do everything possible to turn anything you are suffering from as a result into something pre-existing.

KEEP EVERYTHING in terms of paperwork. Police report, any medical bills, cost of lost work, etc.

And don't settle too fast either. Don't hire a lawyer until you hear their first offer. Be sure to counter for at 3X what they offer you. If they won't budge at all, THEN get a lawyer (who will cost you 1/3rd off the top, remember).

I concur get a settlement that would meet your interest nothing more nothing less. Keep us posted the 86 is a pretty tight knit community.

I have a question.

In a case such as this if the car is deemed totaled, could you for instance keep the tires/rims, or would that go away with the car.

Best of luck, may you have no medical issues and a new 86!

Once the car is totaled it belongs to the insurance company. Some companies may let you swap parts but technically it all belongs to them as it sits when totaled. You could not just pull the wheels and keep them without agreement from the company.

Depends on insurance company, probably not since they are included under the insurance payout(they are paying for them). I doubt the car is totalled unless there is frame damage. Seems pretty restricted to the bumper/lights

That's what i was figuring. I imagine the only way you could argue about that is if you could replace a part you were taking with a stock. Take your shiny new rims and give them the stock ones.

Still would depend on the company and the circumstances. At fault accident where they are only paying the base value of the car then I would think you may have an argument. Not at fault where you are being paid the value of the car and any mods done to it then I doubt they would agree. You can't receive payment for the parts and keep them as well.
There have been guys here that successfully removed mods from their cars without issues.
