Because this would be considered a "cutout" and if push came to shove, it's still illegal under 27151 which blanket covers 27150. If the sound was the same then no one cares, but it will be louder than stock and thus the cutout part applies.

The cool thing about CA is that unlike other states, there's no safety inspection.

Smog inspections only deal with tailpipe emissions and a visual smog check, nothing else. You can run whatever exhaust you want as long as it meets the 95db test limit as stated in the vehicle code.

Many other states don't even have a specific sound limit, so enforcement varies wildly and entirely based on discretion of law enforcement.

Coming from someone that ran it like that for awhile. It doesn't sound really any different than a muffler delete, a little quieter. Sounded decent. The only issues being the exhaust fumes that are being caught under the bumper.

I would suggest a muffler delete for a cheap alternative that helps keep the fumes from being trapped in the bumper.

Whatever you do, don't just take the muffler off. You will end up melting your bumper.
