No it's still starts normal. I forgot to mention that it actually goes into first gear like butter until the car is warmed up which is why I though the whole thing was odd. Cause once it's warmed up trying to go into first gear is like trying to push through a brick wall

If only does it when hot then idk what it would be besides fluid. Try changing trans fluids. Motul 300 75w-90

I'd suggest you bleed the hydrolytic clutch system. There might be air in it.

I have the same issue, but with a aftermarket clutch. Nothing has fixed it.
Replaced the clutch twice, new clutch fork, two new throw out bearings, upgraded clutch lines, bled lines a couple of times, and adjusted the engagement point. I gave up trying to fix it.
I have taken to just shutting off the car to get it in to first when at a stop.

Clutch friction disk warps after it heats up. Defective part. Take it back to the dealer and show them...

edit: ...before you completely wear down your first gear syncro.

Well, that could be.

The OP mentioned that when the car was cold, it went into first gear fine, but not so after the car warmed up.

I was thinking that maybe if there was air in the hydrolytic lines, that the air would take up more space and compress less with a warm car, thus making it harder to get into gear.

for sure the clutch is not disengaging fully when you depress the pedal. I went through the exact scenario as the OP right before i replaced the clutch in my old M3. The fingers on the pressure plate were worn and flexing on pedal press not allowing the disk to release all the way.

On flat ground with engine running clutch pedal to the floor, trying to go into first will cause it to roll forward slightly.

Could be the dealer did not replace all the parts (worn pressure plate, just replaced the disk), air in the hydraulic line, warped disk, etc.

Don't waste your time trying to change the trans fluid.

yeah probably. I was going to just put it back to stock. but my pocketbook is a bit cross with me. And so is the girlfriend.
