I even asked the Toyota Cust. Relations rep about recording maintenance. I pointed out there's nothing in the warranty or service manual describing how maintenance should be recorded. He didn't have an answer because Toyota doesn't have a recommended process for documenting maintenance outside a dealership.

From the sounds of it, they're going with 'insufficient' maintenance records and "usually this kind of failure is caused by over rev." The FTC's interpretation of the Magnuson-Moss Warranty Act requires a manufacturer to prove improper maintenance caused the specific damage for which repair is sought. Toyota should also be obligated to prove an over rev caused the damage according to the FTC's interpretation. It shouldn't be enough to say "well, usually this only happens when the engine is over revved, and you have excess clutch wear."

One of the most frustrating things is that it seems that the consumer protection law in place doesn't mean jack sh!t to Toyota. And outside of dispute settlement, the consumer has to gamble things will work out in court to actually see the law enforced.

I spoke to a Subaru technician earlier today. They confirmed the ECU on the '13 BRZ does record over revs. In the case of Subaru, that data is not accessible at the dealership level. Subaru dealerships have to get someone at corporate level to pull the data. I know that doesn't confirm that the FR-S ECU stores that data, but it seems promising. I called another Toyota dealership in town to ask about the ECU on the FR-S logging over revs. The technician I spoke to had no idea. I emailed the service manager at the dealership where my car is to let him know Subaru confirmed the ECU on the '13 BRZ logs over revs to see if it'd push him to get the data.

Updated first post. Toyota corporate had an FTS look at the car, and the FTS concluded it was not over revved. Now I need to get a fuel sample tested to see if the tank has bad gas. The FTS also thought the oil may have been low at some point. I know they can't show the oil was low, because it never was.

Feels like a small win having Toyota confirm the engine wasn't over revved, but I'm not getting my hopes up just yet. Might be more fighting to do with Toyota.

It's BS. The engine has been opened up sitting in the dealership's shop for a month. At this point, who knows what was on the pistons when it was first opened up and what's collected on them since.

Finally got some good news. Toyota is going to honor the warranty. Parts were ordered this morning. Took 'em long enough.

I picked the car up on Monday. Everything seems to be in working order. It took two months and four days to get the car back. Now I'm just paranoid about sounds I don't remember the car making. I could've forgotten the car makes this noise, but part of me won't trust it for awhile.
