^I'm sure you've already seen this but it's enough for me to feel like I'm not speculating.

I know you're participating in the other thread as well so I'm sure you've read the accounts of this happening to a few others now and at least two (1 x @CSG Mike , 1 x @track_warrior ) complete engine failures due to this, and several others have had their DI seals fail recently.

One more idea, if this injector issue is due to detonation while running 91 and while upshifting aggressively, than the excerpt in the manual that states 91 can be used with no detriment to engine, is false and I would think grounds to warrant engine replacement.

Someone has already downloaded the previously mentioned new ECU calibration that specifically identified the change in transient retard tables, extending the original 5,600 rpm all the way out to 10,000 rpm. http://www.ft86club.com/forums/showp...3&postcount=67

Hence, NO speculation.

Our 1st engine wasn't a complete engine failure. Rather, it only had the misfiring symptom associated with the DI injector seal failure. The engine was taken for analysis and we were given a fresh engine in exchange.

This means that if you lose a lawsuit for breach of either a written or an implied warranty, you may have to pay the customer's costs for bringing the suit, including lawyer's fees.

Quoted from FTC.gov. Refusing to replace the engine if it is found to be a manufacturing defect would constitute a breach of written warranty.....

Subscribed...we've been getting a P0351 code at every event we have tracked the car at. Will be getting updated to the latest ROM tomorrow or early next week - hopefully it will fix the issues with the CEL and potential harm to the injector o-rings.

Sorry to hear of your issues, Mike. Hopefully we are not in the same boat here soon!

Please share details on how you're getting the latest ROM! I wasn't aware that it was available state side yet. I thought it was only out for Toyota South Africa.

Do you have an FR-S or BRZ?

Lots of semantics going on. All race engines will die at some point we all know this. It is not reasonable to think you can race/track your car all you like and then keep ordering new engines when it breaks. Don't mean to be condescending but it is their right to deny a warranty claim due to race conditions or abuse.

How about documenting the failure then sue in small claim court? Small claim may not pay 100% of the replacement cost, but will be very close.

Don't be so quick to make legal or factual determinations, you've been wrong before...
