I'm not really hip to the idea of adding some secret sauce to the tranny to make it not suck on the 1 - 2 shift. Im not saying it wont make a tranny work better but i would like to have it work correctly first. I did try letting it go to the neutral position and that cures it every time. I'm really not happy about that but it will keep me going until I can take it in. Thanks all.

This is your first Toyota branded Subaru too! I would just take it to the dealer and have them note it in the national service history. If you complain a few times and something actually fails then they will address it, sometime even a few miles past warranty mileage. Communication is key. I have not hear of any Toyota/Scion getting through the lines without fluid, of course these are not built at Toyota plants, they are assembled in Gunma Subaru plant.

I took my car in when I had the CEL / TC light pop up. I asked about the tranny and the head tech said the triple syncro design is what causes 2nd gear to be like that. They have noted my concern. He suggested I shift with more gusto and it does feel a lot better when I do that. I might try to add some of that fancy fluid down the road. I'll wait and see how it feels this winter.
