Tint exemption affidavit?

I was just curious if anyone in Oregon has gotten a window tint affidavit stating you can have darker than 35%? If so how did you go about getting it and what does it look like? I just got pulled over and given a fix it ticket for tint that was supposed to be legal, cop decided to gauge it, turns out it is 30%(5% over). I didn't have a card for it(tint place was out of them at the time) but I did have a prescription for up to 20% but it wasn't good enough. Just trying to figure out what I can do short of getting lighter tint or paying the $300 fine.

From an ODOT pdf I found online:

Quote:
Physicians or optometrists may sign affidavits for darker tint for persons with physical conditions requiring darker tinting. This affidavit and the certificate mentioned above must be kept in the car at all times. This darker tint must be removed prior to resale of the vehicle.

My doctor says I need to avoid the sun. Can I add dark window tint because of a medical condition?

You may get your physician or optometrist to provide you with an affidavit stating that there is a physical condition that requires you to have windows tinted darker than Oregon law allows. An affidavit is generally considered to be a legal document that must be notarized. Both the affidavit and tint installers certificate must be carried in the vehicle at all times and provided to law enforcement upon request. DMV does not issue permits for darker window tint.

Go to your doctor. Ask for affidavit (this is just fancy talk for a legal document). They might Notarize it for you, but if not you would need to get that done. Every bank has a Notary. Then keep it all in an envelope (notarized document for tint, certificate from tint installer) in your glovebox.

I saw that in addition to the affidavit you need a certificate from the installer, most installers won't give you one unless it is legal limit tint

If you have a prescription from you doctor or whatever, then showing that to the judge should get it thrown out.. Just because a peace officer issues a citation doesn't mean your guilty of anything yet.. Some people just go and pay whatever fine, you would be surprised how many tickets get dropped because a officer doesn't even show up.. Or reduced or dropped because of a legit reason..

A fix it ticket is 300?! Wtf. I had a buddy pay 50 bucks for a burnt out light and they claimed that to be a fixit ticket. Why is tint so much higher?

Don't know, I think that is what I have to pay if I don't fix it.

Yeah you have a court date and I believe if it isn't fixed by that point they will issue you a ticket for the offense, which is noted at $360 per the Oregon.gov link I posted earlier.

You will need to have the tint removed from all windows, as Oregon law is 35% all around. Once it is removed you can go to your local police station and have them sign your fix it ticket certifying that you have corrected the issue.

Make a photocopy of the front and back of the ticket for your records, then mail the ticket to the courthouse or drop in and hand it to them personally so that you can get confirmation that nothing more is required from you.

Quote:
HOW DARK CAN WINDOW TINT BE IN OREGON?
Darkness of tint is measured by Visible Light Transmission percentage (VLT%). In Oregon, this percentage refers to percentage of visible light allowed in through the combination of film and the window.
• Windshield Non-reflective tint is allowed on the top 6 inches of the windshield.
• Front Side Windows Must allow more than 35% of light in.
• Back Side Windows Must allow more than 35% of light in.
• Rear Window Must allow more than 35% of light in.

HOW REFLECTIVE CAN THE TINT BE IN OREGON?
Similar to sunglass lenses, some tinting film contain metallic elements that help in reflecting incoming light and reducing the glare and heat generated by visible light.
• Front Side Windows Must not be more than 13% reflective.
• Back Side Windows Must not be more than 13% reflective.

OTHER OREGON RULES AND REGULATIONS
• Restricted Colors The tint color(s) of RED GREEN AMBER are not legal by state law.
• Side Mirrors Dual side mirrors are required if back window is tinted.
• Certificate Requirements Manufacturers of film need to certify the film they sell in the state. Ask your dealer if they are using ceritified film.
• Sticker Requirements No sticker to identify legal tinting is required.
• Medical Exemption State allows medical exemptions for special tint. For more details about the specific terms of the exemption, consult your state law.

When i got my window tint ticket a few years ago. I peeled off the drivers and passenger side windows and took pictures of the car with no tint. Went in for my court date and showed the judge and he dropped it right then.

I got a $170 ticket for having a headlight out in Corvallis. Not even a fix-it ticket.

Plead no contest and paid $15 though.
