Remember that the main motivator for any safety initiative or law in North America is to make $$$. I believe that insurance companies demand a citation in order to increase rates and recover their money.

That is why "speed" is cited as a factor in every traffic accident report. Think about it, if speed had been zero, there would have been no accident!

I think the section number under which you got the ticket should be on the ticket, then you can look it up here http://law.lis.virginia.gov/vacode/title46.2/chapter8/ to figure out the best defense.


It could have been one of the other reckless driving sections, like
§ 46.2-861. Driving too fast for highway and traffic conditions.
A person shall be guilty of reckless driving who exceeds a reasonable speed under the circumstances and traffic conditions existing at the time, regardless of any posted speed limit.



I have no idea though what argument can be successful to beat it. For 861 I might try to argue that the speed was reasonable under the conditions known to you (wet road) and that a reasonable person would expect that an interstate ramp is properly drained and there is no standing water. Can you prove that there was standing water there, do you have a picture?


Maybe you will be offered a reduction to improper driving (see 46.2-869).

Still, all of the above are just thoughts of a normal person, they may be reasonable but legally meaningless.

Update: I've lawyered up- they reckon they can get it thrown out or reduced to something with no points. Also, I've acquired a WRX.

I think you're on the mark for the bad luck idea. In the year and a half before her untimely demise, she had: been rear ended once with no damage, hit and run with damage, broken wheel in pothole, 4 flat tires, and any number of minor things.
