It might not be an issue since our cars look like two-seaters from the outside, but if you do get pulled over, I'd make the cop sit back there before writing me a ticket

Well if you have your back seats down you don't have 3 people so only having 2 in a 3+ lane is a violation... I do 1 driver and 1 rear passenger (in a carseat) in the 2+ lane all of the time without any issues. Some people give me sneers until they see the kid in the back. Then they look embarrassed.

One guy was flipping out at me, and then he saw my kid and just pulled his arm back in his window and rolled it up. Slowed down a bunch as well...

Kids should not count for carpool lane. If you're not carrying other licensed drivers you're doing nothing to reduce the amount of vehicles on the road and should NOT be able to use the lane.

If I didn't have to lug my kid to/from daycare, I wouldn't be on the road in the first place. I'd be on public transit. So I think they definitely count...

Find a daycare closer to home. It still shouldn't count.

I'm not saying I wouldn't use it if I was you, hell yes I would. But I would still think it shouldn't count.

Certain routes in the San Francisco Bay Area I-80 and I-880, Los Angeles I-10 El Monte Bus Way (during peak hour) and San Diego I-5 San Ysidro requires three or more (3+) persons per vehicle to access the HOV lanes. Signs along the highway will specify the enforcement policy for each route. For San Francisco Bay Area ONLY, originally factory designed vehicles with a maximum two-seat occupancy may access the HOV(3+) lanes as long as there are two occupants in the vehicles.
So I quoted this from http://www.dot.ca.gov/hq/traffops/sy...s/hov/hov_sys/

I'm just confused. So our car is originally a 4-seater, but if I always have the back seats down, would it be able to be a 2-seater making it able to drive in the carpool with a passenger? I know it says factory designed vehicles, but my backseat is useless to me regarding passengers so I always leave it down for luggage since I travel to cencal a lot

Our insurance is a little cheaper because of the back seats, hence designed that way for that pro but con of not being able to use the back seat if your on the taller side.

It's 4 seat car. I think that's pretty clear whether the seats are up or down. You might be able to skate, but you could get fined. It's not a moving violation so maybe it's worth the risk.

Even with the seats down the rear seat belts are visible.
