I was going to go get a poke bowl for lunch, but damn, now I'm craving that Sausage McMuffin with egg.

Let's see, which would be better for my diet, raw fish and veggies or a McD gut bomb.

I'd stay away from the fish ....... they are loaded with heavy metals and PCBs, which caused a slow painful death.

The loaded sausage McMuffin with egg, would just bring on a heart attack, which is a quicker, less painful death.

Technically, you could literally be at home, have a beer in hand, realize you forgot something in your car which is parked on the street, run out to the car to grab it and be fined for care and control.

The laws don't make sense in some scenarios, which again, DISCRETION should be used.

No that would not count. You have to be in the car or have obvious intent to do so (such as unlocking the door). Obviously you could come out and drive at any time but sitting in your living room or even a bar does not put you in direct care and control of the vehicle. I know there was a case that made the news where a guy was arrested for impaired while on the side of the road changing the tire. He attempted to fight stating he was not even able to drive the car when caught and he was going to leave it and come back. They didn't buy that and he lost.
The whole thing is that even though the cops are not supposed to use discretion in these cases I bet they actually do more often then not when the car is not actually moving. You of course don't hear about those people they just tell to take a cab.


We need to keep in mind that the system here is set up with two levels of severity (0.05 to 0.08 = ticket and 0.08 or higher = criminal) and a three strike system for the penalties for each level. They are not going to take a first offender and toss them in jail.

0.05 roadside suspension is bullshit. Being penalized before you get a chance to defend yourself is no bueno.

Your buddy could have killed somebody but that seems to be OK with people as long as his "rights" are not infringed on.

Does it matter what's happened in the past? The fact of the matter is that he was found in a parking lot, adjacent to a bar, passed out in his truck. He had zero intent to drive.

And fuck yes it does matter if civil liberties are being infringed upon. How is it ok for a cop to be judge, jury and executioner, especially when the validity of breath samples has come into question. How many people had their lives ruined because the sample showed a higher BAC than what was in their system?
