I'm not too concerned about the depreciation (I explained it in another thread, but basically I like the peace of mind of knowing that the car wasn't beaten on like some used cars, plus having a warranty is nice). I'm just looking for the right house to pop up, but the prices right now are so good, as are the rates and credits/programs for first time buyers. I just wish I made more money so I could've used all of these things for a bad ass house. For example, he's not a first time buyer, but my boss bought a three-story house in Corona del Mar (in Newport Beach) for $1.475 million, but it was originally listed at $3 million, and at a favorable interest rate. If only I had a little bit more money. |

Did you really expect a sales person to stop in the middle of making a deal to call you and let you know that someone else is probably going to buy it?

Statistically, we (salespeople) have the best opportunity to sell a vehicle when the person is in front of you. Sure, you can leave a deposit over the phone to hold a car, but it's not sold until the customer takes delivery and drives it off the lot. If the salesperson involved here, just didn't call the OP back because the dealer screwed up, then it's bad service, but if the person didn't call the OP back because of being with another client then I feel the sales person did the right thing. I am guilty of sending a customer a text while on a test drive with another client though. It usually is short and says that I am with someone, but I will contact them as soon as I am free. Ruskymx |

No, the word expect is too strong I guess. Would have liked? I just don't like being misled. If I'm #1 on the list, and there's nothing I can do to be #1 except being there physically first... then they should have told me that before calling me and telling me to come down.

Plenty of us put down deposits before we had even seen the car in person so I don't think you're going to find much sympathy here. Grow up and get over it. |

The way I think it should've been handled is that they take a deposit from you and when they find out what their first one is going to be, (which they will know a few weeks in advance), contact you and let you know what it is and give you the option of having the opportunity to purchase it. I won't take a deposit from someone though to lock up a car that they are not going to buy and just want to test drive it. If you would possibly purchase the car, then that's a different story. I absolutely honor people on our lists whether it is for a FRS, Prius C, or Prius V. We have order lists for all those cars and when we get our hands on one even if it doesn't match what the people want, we go through the list and contact the customers in order to give them the opportunity to check it out and switch their order. (Good example is that we have a Raven 6spd FRS right now coming into us and we need to get an Asphalt one, but aren't having any luck switching it) If they don't want it, then we use it to try and do a dealer trade to obtain one of our sold orders. If we can't use it to secure the first sold order on the list, we try the second, then the third and so on. What is messed up about this whole scenario is that the dealer didn't take a deposit from you and you didn't insist to give a deposit to LOCK up position #1. The dealer was wrong for leading you to believe that you'd be #1 w/o leaving a deposit. Just out of curiosity, was your SP a newbie or someone that was there for a while? My dealership will hold cars for some of our best customers w/o a deposit, but not for someone that just calls us out of the blue. You would need to have bought multiple cars from us and service your cars there for us to hold something without a deposit. Put yourself in the shoes of the person there willing to buy the white one they had. If you were sitting there and the SP told you that they talked to someone earlier and they wanted to check the car out and maybe buy it but didn't leave a deposit to hold it. You had to sit and wait until the other person made their decision. The other scenario is if it was a First 86 car and wasn't available to start with, the SP should call you and apologize for the mix up and be honest of his/her mistake instead of making up a story of a customer being there and buying it. Without leaving a genuine deposit of some amount and getting something in writing/via an email, you should have no expectations that a dealer is going to hold a car for someone they briefly spoke to on the phone. The FRS isn't a limited run, you'll get one sooner rather than later

A situation like this usually happens on used cars but does occur on new/high demand vehicles. If I had $1 for each time it has happened during my 10 year tenure at my dealership, I'd be able to at least make one maybe two payment on my FRS when I get it. Lesson to be learned from this is as long as the deposit is refundable, better safe than sorry. ![]() Ruskymx |

I, again... completely understand what you guys are saying about the deposit thing BUT he wouldn't take one even if I offered. I'm over it and have two dealerships+ working hard for me. So I'm not sweating it. It was not a big deal for ME personally, but I thought it was messed up for others in the community and that's why I decided to share. It's not that I took it personal for my sake, but if you read my previous experience with Nissan, you'll maybe understand why I don't like this waitlist B.S., deposits / no deposits, etc... without the dealerships being clear.
I am plenty grown up and I am over it. I'm good. Like I said, it's a learning experience and I just wanted to share my story so other people don't expect what I thought to be a common courtesy. Sorry if you guys take it as me complaining just for the sake of complaining, it's not. I just want to spare someone some agony waiting on something that can be sold from right under them. If this was my one and only car that I wanted, and especially if I changed my mind about not wanting white, I'd be STEAMED. But as many of you have pointed out, white was not my favored color. So it's fine. I hope the first86 get their cars fast and we can start to get our orders filled! I don't want to argue with anyone about if I was right or wrong expecting this NOT to happen, because it was just a FEELING that I got. No legal consultation, etc. Just a feeling. Just thought I'd share, take it or leave it. Now it's friday, so I'm going to have a few beers with my dad. Cheers. |

It sucks but the way I see it is if the dealer knew you weren't interested in white but was going to let you test drive it to get a feel for the car that's fine and all. But if they had a customer come in who was interested in it then I don't think it's unreasonable for them to disallow you to test drive a car that they know you have no interest in when somebody else is interested in purchasing it.
I'm #2 at my dealership and I would NOT want #1 driving my car if mine was the first to come in. Nor would I want #3, #4, #5, or people curious about it driving it either. Maybe that's unreasonable on my behalf but I don't think it is at all. They can take it to fill it up (damn well better be Premium, I wonder how many of these are accidentally going to get filled up with Regular), do a PDI and make sure it's squeaky clean but I'm not really interested in having anybody test it out that doesn't NEED to touch it. |

Welcome to the real world. If you grow and learn from this lesson then you'll be a better person for it. But you can't expect sympathy from the hundreds of people on this forum who went in and successfully negotiated with the dealership and put deposits down on their car and have ETAs.
A promise and a handshake doesn't cut it. A salesman makes you a promise that he'll sell you a car, get it in writing. Moreover, make sure it is an enforceable contract. I find it hard to believe that a dealership isn't willing to take your money. You should have asked yourself why the sales person wouldn't accept your deposit. What's more likely: that the salesman wasn't interested in taking your deposit OR the salesman couldn't put anything in writing because his allocation was already sold out. He probably wanted to keep you on the hook just in case his other buyers backed out. Now, you could have done a number of things when you were at the dealership. You could have called the salesman on it. You could have insisted that he put his promise in writing and accept the deposit. You could have asked to speak with the manager. Instead, you just complained on the internet.

No, I'm not on the Ninja 250 forums. The only Kawi forum is ZX10R.net and Kawiforums. Another member here mentioned that he has seen my avatar on the Club4AG forum and when he sent me the link it happen to be another guy on a green Kawi wearing a blue suit. It looked similar but wasn't me.

I really thought this thread was going to be off to the races after the "fucking idiot" comment. Nice to see cooler heads prevail for once on here.
Godzilla35, I have to agree that the dealership was in the wrong for not giving you a heads up when it really could have inconvenienced you. They're potentially going to be selling you a brand new car in the near future so it would help to get off on the right foot. IMO dealerships (and businesses in general) should try to treat all their customers with respect regardless of how much money they make.

Maybe, what's your name. The last post I made on KF was back in '09 when I sold my suit and I did have a 05 ZX6RR. I'm on several moto forums and met so many people that ride that I call them by their real name and not their s/n. When you were in SD, were you on Hypercycles?
